Tuesday, January 08, 2002 11:25 AM 9/11 Victim compensation plan While no amount of money will replace a loved one, I am totally appalled that the families of the individuals that died are becoming millionaires while charities throughout the country are having difficulty meeting the needs of their constituents. Americans, by their very nature, have always been the first to respond in times of tragedy and need. Everyone was devastated by the terrorist attack... we're ALL victims.....does that qualify us for financial assistance as well? I can not believe that the individuals who responded to the pleas of the tragedy intended that the "victims"relief fund would generate income making the survivors rich! And the inequities of the pipeline......firemen are worth more than Port Authority security officers....waiter's wives' want more than $2.8 million dollars!!! How much is a life worth?...Or have we decided that priceless, does indeed have a price? And the audacity of the fact that this fund is perpetual. Please! Not even life insurance policies guarantee income for life. What about the funds that the families have received from the Fireman's fund, the Red Cross and United Way, as well as, all of the other "charities" established to help these "victims"? Shouldn't the distribution of these funds included in the government handout instead of an addition to it? Don't get me wrong.....I think that we should come to the aid of others - not only during times of major tragedy, but whenever there is a need. But it's criminal that these victims' receive allocations that far exceed anyone's actual expectations. I don't know many individuals under the age of 30 that earn a 6.6% annual pay increase...nor anyone under the age of 50 that get 5.1% annual increases. Something is wrong here, when the American taxpayer is required to pay his hard earned money to make millionaires out of a national tragedy. People get killed all of the time....it's always tragic to those involved. How are we going to compensate them? I think that in its' haste to be generous (and to avoid law suits), the government overstepped its' responsibility to ALL Americans. This issue should be readdressed before final action is taken. Friday, November 09, 2001 1:35 AM Battery Park City, New York I am concerned about he people who live (or lived) in Battery Park City. I don't understand how they could not be classified as "Victims" of the terrorist attack. They certainly are victims and must be classified as such. They were victimized on September 11th, they are our neighbors and they need our help. My best friend was in her apartment only 1 block away when the first plane hit. She was there when the 2nd plane hit. She was there when the towers fell. Her elderly parents were visiting her - so they were there also. THEY WERE IN THEIR APARTMENT ALL DAY AND ALL NIGHT - watching the buildings around them burning. They were evacuated on September 12th. She now has a choice: (1) return to live in her contaminated apartment and hire an environmental expert to decontaminate the salvageable items and breathe in contaminated air every day and every night or (2) move to another apartment and still hire an environmental expert to decontaminate her salvageable items. Under either option - she will receive NO ASSISTANCE FROM THE FUND ESTABLISHED FOR THE VICTIMS. Some of her neighbors aren't as fortunate as my friend - they don't have the money or the financial credit to move. There are young children and elderly retired folks breathing in contaminated air on a daily and nightly basis. They breathe in smoke mingled with contaminated tiny air particles made up of dead bodies, office furniture, paper, walls, floors, carpet, airplane debris . . . This is an outrage. Our government, WE THE PEOPLE, should be helping the residents of Battery Park City. I urge the USDOJ to amend the definition of "victim" to include the people of Battery Park City. Saturday, December 22, 2001 10:21 AM FW: loss tables I have just reviewed the tables and am both dissapointed and furious over the way the figures are shown for a single person. At a meeting I attended monday night the special master led us to believe that a reasonable amount of economic loss plus a 250,000 amount for non economic loss would be considered. My son was 38 and earning approximately 30,000. Assuming he worked until age 62 he would have earned approximately 720,000 before any earnings adjustment for increases etc. Based on the table figures, including 250,000 non economic loss we would get approximately 411,000 before any collateral offset. That would make his earnings loss worth 161,000 for 24 years-6,500 per year. That seems to be totally absured and unfair. How can the actual loss of earnings before any upward adjustments go from 720,000 to 161,000. In addition if he had one dependent child his award would be 594,000 instead of 411000. The difference should only be the non economic amount of 50, 000. If he did not have a child he is being penalized on his economic earnings. This award amount is totally inadequate and unfair. In our time of grief when the government is supposed to be helping us reach a quick settlement they are doing nothing but creating more grief for us. Monday, January 28, 2002 11:55 AM Comments Dear Mr. Zwick: Although recent news articles indicate that many people are not familiar with the proposed rules of the fund and are therefore criticizing the "greed' of the victims' families, I want to say that I have read the proposal in detail and I believe it is MORE than fair. In fact, I am appalled that these families may even receive that much of my tax dollars. What has come of our society, that people believe they must be ?compensated? for the loss of a loved one? Certainly there should be some way to help those who lose the means to earn a living, but to the tune of hundreds of thousand to millions in tax-free dollars? Social Security includes a provision to help a person if they become total disabled and unable to work ? losing their source of income. It only provides benefits of less than $20,000 a year in most cases. Most of these beneficiaries lost their ability to earn through no fault of their own ? why are terrorist victims valued so much more? I understand the purpose of the fund is to head off lawsuits that could be even more damaging to the economy, and the right to sue for ?compensation? is another issue as well. For now, I hope the government will stand firm in this plan, reduce any awards as indicated to account for life insurance, etc., and even consider lowering the amount to be paid as a whole. This legal tradition may create a way for the Special Master to compensate significant others and same sex partners who cannot collect on the Wrongful Death claims for economic damages, which ordinarily are distributed to dependents. Tragic deaths occur all the time and are not turned into an equivalent of winning the lottery for the survivors. This money would be much better spent to prevent future terrorist attacks. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Thursday, January 31, 2002 3:23 PM 9-11 Victims' Compensation Dear Mr. Feinberg: Thankyou for the opportunity to comment about the law governing victims' compensation for the September 11th tragedy. I understand that I am late to this, however, an editorial in the Washington Post by &nbsp&nbsp&nbsp&nbsp has promted me to share my opinion. First, let me say that I am not related to anyone who lost a loved one that day. I have many ties to NYC - my husband and I traveled many times through the Twin Towers and had a first date in the Windows restaurant. We feel great sympathy for the families and we, as well as our children, donated money to organizations helping these families. What has me concerned is the apparent sense of entitlement and growing dissatisafction on the part of many of the victims' families about the governments attempt to "compensate" for their loss. On many levels, this is disconcerting and sad. What I cannot fathom is, no amount of money can "compensate" for the loss of a loved and if it were me, any monetary payment would be welcomed as I begin to make peace with the loss. Why do these families want to prolong their grief- as in lawsuits - to inflate their compensations? If , as so many families state, it isn't "about the money" then why are they complaining and threatening if the guidelines are not changed to suit them? As I reviewed many of the comments, there were several issues that I felt compelled to respond to. In no particular order: 1) Definition of "kin" - It seems that there are several groups of people who do not agree with the definition of family member for beneficiary purposes. I agree that gay partners should receive any compensation due their partners. Since they cannot legally marry, if they can prove that they were in a "marital" or otherwise, familial relationship, that should fulfill the definition. As for fiances - the fact that they were not married does not entitle them to the same rights as those married. Sure, there is likely the same loss and perhaps people cohabitating feel they should be viewed the same way, and I find it rather interesting that there was no urgency to "make it legal" for cohabitators yet when it comes time to "collect" the goodies associated with legal status, then, it becomes and urgent matter for them. There has to be some reasonable way to define family member which is consistent with other types of governmental entitlements or legal terms. 2) Issue of "justice" and "non-economic" collateral - In some of the comments, people reference the cap on "pain & suffering" awards. First of all, the issue of the collateral source rule does not have the same application here as in other crimes. The government - who is making the award - is not responsible for the loss. It is only out of generosity and sheer magnitude, that these victims have a hallowed status among others in the government's eye for justice. We did not compensate other victims of other tragedies (Oklahoma etc) to anywhere near the degree. Most Americans would be happy to see victim's families receive a fair compensation; we just do not like the unappreciative comments. Since no amount of money would be adequate, there again has to be a reasonable way to calculate the awards. It seems that people do not like the way that their family member were "valued" compared with others. One woman had the nerve to state that her husband was an ivy league educated MBA and the implication was that he should have a different amount of compensation than the firemen because they had a "choice" to go in an risk their lives and her husband was only going to work. What did she think those firemen were doing? It was the firemen who chose to go in and save others lives. Surely, it is not a penalty to deduct the value of life insurance policies. The fact that some people planned better for a catastrophic financial loss should be of great comfort to those whose family members did so. Instead, some believe that they are being punished. There will be no way to assuage everyone's feelings about the issue of value and compensation and fairness. It seems to me that the only way to view this tragic "pay-off" is to keep it equitable as the same loss was experienced by each of the families. That there may be huge disparities among the future losses (of income, companionship etc) cannot be compensated for......... I wish you much luck and wisdom in sorting this out. I think you have made a fair and reasonable attempt in enacting these guidelines. As a very patriotic American, former New Yorker, current Washingtonian, I am deeply outraged at this attack and feel deep sympathy for the families. We all cried billions of tears for this loss of life. It seems, though, that we must quickly determine what is a fair compensation and move forward. I hope that the victims' families can try to view this law as an unprecedented outreach by our government and our citizens to, in part, allow them to also move on with their lives with some measure of financial security. Do not allow greed to taint this outpouring of generosity and collective spiritual support. I wish everyone peace.
