Wednesday, December 19, 2001 10:35 AM Distributions I don't know if this comment has a "number," however I feel it is necessary to point out the fact that a lot of large distributions will be made to people who may not necessarily know how to handle large amounts of money. My fear is that people will go through the money quickly and then be left with nothing for dependent children, etc. Possibly at least in the case where there are children, a portion of the money could be set up in trusts for them to be used for education, catastrophic medical expenses, etc. as though it were a trust left by a will. Sunday, January 20, 2002 4:59 PM Comments on regulations The Federal Legislation that set up the Victims Compensation Fund also significantly limited the ability of victim's families to sue for damages by restricting damages against the airlines. In light of this, I think that your regulations are too stingy. Victims should be compensated for all their damages; pain and suffereing awards should be minimally $500,000 but potentially more for those who can show additional damages. Lost wages should be based on a model that more realistically reflects earning potential for the victims, many of whom were young and just starting out in their careers. Additionally, the only cap on damages should be on what can be proven. I also think that people who paid for private life insurance should not be penalized for making the sacrifices that buying expensive life insurance entails. Finally, when victims were supporting other family members life elderly parents, this should also be taken into consideration. We owe this and much more to the families of those who were lost. People gave to this fund with the intention of giving all the familys of the victims equal funds for their use. To use a person's salary to administer the amount they receive seems very unfair. All familys suffered equally so why not distribute the moneys equally? I hope the Justice Deaprtment reconsiders this method of payment. I live in a small city where we lost 10 people at the WTC and they are all entitled to the same amount as the lowest paid person on the list. Please reconsider. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Friday, January 11, 2002 9:20 PM Victims Compensation Act My name is &nbsp&nbsp&nbsp&nbsp . My husband, &nbsp&nbsp&nbsp&nbsp was a Firefighter at the WTC on 9/11/01. I am 41 years old and now a widow. My children are ages 9, 7 and 3 and will never again be able to have the love and support of their father. If it were not for my husband and his 342 other colleagues there would have been many other lives lost and hence, many more claims to pay. I do not understand how my husband's life and particularly his contribution to the saving of lives is worth nothing to you. He did not have to be there. He could have run the other way. Instead, he faced the danger and made the ultimate sacrifice. Why would the $250,000 award I received for a LINE OF DUTY death be deducted from this award? By doing so, you are simply doing away with that award, and thereby, not recognizing his sacrifice. Why would you deduct a pension from this award? The only reason that I will be getting a pension is because his death was in the line of duty. If he had passed away at home, I would not receive a pension. This is simply a benefit because his death was on-the-job. By making this deduction, you are saying that he deserves no special financial accommodations just because his death was caused by his occupation. Why would you deduct life insurance? My husband could have elected to accept the $8,500 life insurance policy that the Fire Department provides. Instead, he opted to contribute to a special life insurance policy ($150,000) each paycheck. First of all, this cost us money, which I doubt you will reimburse us and secondly, why should my husband be penalized for looking out for his family? How can you possibly calculate future earnings? How do you know what increases they would have received? How do you know how many promotions they may have received in the future? How do you know upon retirement that they may not have obtained a position that might have proven to be more financially lucrative? To me, this is not a matter of dollars and cents, but rather putting a different price tag on each individual's life. That is the part that is most unsettling to me. Why not just split the money evenly amongst all of those who lost their spouse, etc.? To me that is the only fair and equitable way to settle this matter. This way, NO ONE can claim any bias or favoritism. If for some reason, this is not an acceptable option, then some reasonable calculation method must be utilized. YOU MUST NOT LOOK TO SAVE MONEY AT THE EXPENSE OF THOSE WHO SAVED SO MANY LIVES!!! To say our husband's lives are worth less than a Stock Broker's or a Bus Boy's is an insult. Please re-evaluate your current plans for the distribution of the funds to ensure an equitable settlement for all. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. The Red Cross has worked closely with groups in New York City and have implemented a similar policy in compensating gay and lesbians and their families. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. This importantly should include the partners and children of same sex unions. I am writing to express our concern about how funds will be disbursed through the September 11th Victim Compensation Fund of 2001. There has been much discussion about providing victim funds to "domestic partners," the unmarried partners of either homosexuals or heterosexuals. The effort to provide funds to non-related sexual partners of those killed in the 9-11 attack is a homosexual-inspired plan to redefine and to undermine traditional marriage as an important cultural institution. Homosexual activist Michelangelo Signorile, writing in Out magazine clearly states the goal of homosexuals to destroy traditional marriage. He says that homosexuals should fight for same-sex marriage and once granted, "redefine the institution of marriage completely. . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can undertake-and one that would perhaps benefit all of society-is to transform the notion of family entirely." To provide victim compensation funds for "domestic partners" of homosexuals or heterosexual unmarried couples is to help accomplish the homosexual goal of redefining and radically altering the notion of family altogether. Such policies will also pave the way for the legalization of homosexual marriages. The traditional family should not be undermined in this way. As social researcher has stated, "There never was a society throughout all history ... without a family as the central unit for launching the education of children, for character formation, and as the moral agent of society." The "family" Etzioni is referring to is comprised of a husband, wife, and children who are related by blood or adoption. Social scientists understand that children need both a father and a mother in order to develop properly. This traditional family is the building block of our culture and civilization and it should not be redefined or undermined by creating such fake "family" units as "domestic partners" or "civil unions" where two same- or opposite-sex unmarried couples share sex. Using the definition of "family" favored by homosexuals, any grouping of two or more individuals could be called a "family" and be entitled to federal victim funds. A number of homosexual and heterosexual swingers are involved in "polyamory" or sex with multiple sex partners. Surely, these groupings of sex partners should not be entitled to 9-11 victim compensation funds, yet if funds are given to "domestic partners," these groupings could legitimately demand federal dollars as well. We are opposed to providing victim compensation to non-family members or to the estates of the deceased individuals. Family members should receive these funds, not the unmarried or casual sexual partners of those who may have died in the 9-11 terrorist attack. There is considerable danger in providing funds to a deceased persons estate. How do we know where this money will go? Will the federal government investigate each persons estate and his will for the disbursement of funds from the estate? Will the money go to fund homosexual activism, the KKK, a terrorist group, or the North American Man-Boy Love Association? No one can know for certain unless each last will and testament is scrutinized by a federal agent. Victim funds should not be simply deposited into a persons estate. The money should go to the widowers, widows, and orphans created by 9-11, not to political causes. Unfortunately, it appears that homosexual activists are more concerned about exploiting the 9-11 tragedy for their narrow political objectives than they are in seeing that victim funds help the widows, widowers, and orphans of 9-11. Let me say it once again: Victim funds should only go to family members related by blood or legal adoption to 9-11 victims, not to unrelated, unmarried acquaintances, estates, or to political causes favored by homosexual activists.
