I strongly urge the Department to draft regulations that ensure compensation is available to ALL whose loved ones were victims of the attack, regardless of the form their families and partnerships may take. In such a time of tragedy, all who have loved ones (spouses and children alike) have also lost a bit of themselves. No one, regardless of ethnicity, religious beliefs, or sexual orientation, is immune from the grief. All suffer in the days, months, weeks, and even years following such an unspeakable event. That suffering is a mix of emotional, spiritual, physical, and economic manifestations. PLEASE recognize the suffering and needs of ALL who have lost loved ones and draw no lines that would exclude segments of grievers whose lifestyle, belief system, or religious dogma is not in agreement with yours or any other vocal group. There has been a large enough display of hatred and intolerance in the September 11 attack. In order for people to heal and for this country to remain hopeful and resilient, we must honor ALL of our dead and embrace ALL who suffer. The practice of exclusion and discrimination that some radical groups promote is, I believe, antithetical to the universal teachings of love and respect for others. To exclude the families of gay and lesbian Americans would be as unthinkable as excluding the families of Indians, Pakistanis, Jews, Iranians, or French from our plans for compensation. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. While it is appropriate to be strong and move on as a nation, it is also important to remember the victims of the attack and acknowledge the pain caused by the loss of so many lives. Our desire is to make sure no one, no matter how small, is left out when we recognize the victims. As you know, on September 22, President Bush signed into law H.R. 2926, the Air Transportation Safety and System Stabilization Act (Public Law 107-42). This act contains a provision, called the "September 11th Victim Compensation Fund of 4001," that creates a government sponsored fund for those victims who choose not to sue the airlines. We request that unborn children killed in the terrorist attack be included as eligible "claimants." Some of the victims, we do not yet know how many, were pregnant when terrorists snuffed out their lives. Some husbands not only lost their wives, they also lost their unborn children. Some parents lost their daughters, and their unborn grandchildren. For example, , 36, two months pregnant with her first child, left the following message on her husband's answering machine before senseless terrorism took her life: " ? , pick up the phone. Honey, pick up the phone. I was just calling to tell you I love you and I can't wait to see you. There's a little problem with the plane, but I'm fine, I'm comfortable. Please tell my family that I love them." was a passenger on United Flight 93, which never reached its target in Washington, D.C. because the passengers sacrificed their own lives in a heroic effort to thwart the terrorists' plans. Certainly, there were many other pregnant women and unborn children whose lives were stolen away on September 11. We request that you include the smallest victims of all, unborn children, when you draft regulations to implement the victim compensation program for those who were killed or injured by the terrorist attack on September 11. The right thing to do is to recognize all the victims and all the losses incurred by surviving family members. Thank you for your compassion and your hard work as you fulfill your duties. Wednesday, January 16, 2002 12:18 AM Victims Compensation Fund of 2001 January 15, 2002 To Our Elected Officials: In the immediate aftermath of the tragic attack of The United States, on September 11, Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims' relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked - the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman ,"...every death is tragic. A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die...Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise about that ever..." We request that the interim rules be amended and that compensation for pain and suffering more accurately reflect that horror which was suffered. Justice demands no less. As someone who is experiencing first-hand the bureaucratic nightmare generated by variants in private and public aid institutions, I implore you to consider this - that the Victims Compensation Fund as currently written alludes to a series of economic and non-economic "criteria" (undefined). While commenting on what is not known is difficult at best, I offer these concerns: Collateral subtracted from compensation punishes those families of victims who paid for policies and benefits and Federal programs out of their salaries, who lived within their means and saved and whose surviving family members have already struggled to receive help from an array of charity funds whose donations were intended by the American people to be distributed to those families regardless of circumstance. There is no consideration of the amount of income contribution or benefits (such as health insurance) that have been lost. The relative pain and suffering of the victims cannot and should not be quantified in these circumstances; to attempt to do so is wildly inappropriate. The administrative cost of information gathering, verification, documentation, and evaluation required to implement this process would proportionately reduce the funds available to the families and put them (yet again) through unnecessary bureaucracy. The requirement to accept the offer in lieu of pursuing a lawsuit prior to knowing the dollar amount of the payment is egregious and unfair. The possibility of subjective evaluations raises the potential of inequity and places the burden of proof on those seeking some sort of help. For all these reasons, I urge you to abandon the arbitrary set of criteria set forth in the rules and regulations and simply divide the total into equal cash payments to every applicant. Otherwise, I believe that this Act will spawn the hundreds, perhaps thousands of lawsuits it seeks to avoid. Friday, November 09, 2001 3:55 PM NRLC comment on victim compensation This comment is from the National Right to Life Committee (NRLC). We urge that in implementing the victim compensation provisions of Public Law 107-42, the Department of Justice explicitly recognize unborn children who were injured or killed in the September 11 terrorist attacks as eligible claimants. This would allow surviving family members to obtain recompense for the loss of these unborn children. As a matter of policy, this would be consistent with the position that President Bush took in endorsing the Unborn Victims of Violence Act, (HR 503), prior to passage of that bill by the House of Representatives on April 26. H.R. 503 would recognize any "child in utero" as a victim for purposes of CRIMINAL prosecution, if he or she is injured or killed during the commission of any one of numerous crimes under Title 18. See Statement of Administration Policy at www.whitehouse.gov/omb/legislative/sap/107-1/HR503-r.html. Please note especially the statement, "The Administration would strongly oppose any amendment to H.R. 503, such as a so-called 'One-Victim' Substitute, which would define the bill's crimes as having only one victim -- the pregnant woman." Enactment of H.R. 503 is necessary because of the specific constitutional requirements for successful criminal prosecutions, but no such issues arise with respect to the victim compensation provisions of Public Law 107-42. Under PL 107-42, it is clearly within administrative discretion to recognize that unborn children are "individual[s]," whose death represents a real loss to surviving family members. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
