However, it probably wouldn't hurt to reduce the life insurance compensation by any premiums directly paid by the deceased. Overriding wishes of the deceased: As far as the Special Master not agreeing with how the personal representative intends to distribute the compensation, I don't think you should get involved. As long as the PR is acting according to the will, if any, and the laws of the state in question, the Special Master should not be make this type of value judgment against the express wishes of the deceased. The 'true' victim is the deceased. The 'survivors-of-a-victim' are only secondary. Any overriding of the wishes of the deceased should only be done in a case of unquestionable NEED (poverty-level type 'need', not Wall Street hot shot type 'want'), not just GREED. State laws (at least my state) have built in provisions for elective-share for a spouse who is really getting screwed, so let that be invoked. You should follow the determination of the state if at all possible. There may be very good underlying reasons for provisions of the will which the PR nor you have any notion of. Economic Compensation: I really don't understand why these 'survivors-of-victims' will receive, in effect, a life time of handouts when our federal law has explicitly stated that welfare has a 5-year lifetime eligibility limit. Why isn't there a 5-year limit on this 'welfare' program too? 401ks/IRAs/etc: The 'other source compensation' value of these sources needs to be evaluated intelligently, taking into account economic conditions and the eventual recipient of such benefits. For example, a spouse may be entitled to wait up to 5 years before having to take over a 401k, but if it goes to a non-spouse there may be a 60-90 day time frame. This can GREATLY impact the ultimate value of what is received. Make sure a Sept. 21, 2001 document is presented as the supposed 'current' value! Also, given the variations in when investments may have to be 'cashed in', you should probably consider the types of investments, their current value, their expected future value (relative to 'cash in' time frames). It is a tricky situation, but even I am able to figure out how best to play this one - get the government to reimburse any losses realized over the last couple years while protecting my ability to make up that loss again by holding off for a while. This fund shouldn't be providing 'free capital' for 'speculators'. Question for the Future: Insurance companies 'rose to the occasion' this time around and agreed not to invoke war/terrorism clauses as far as making good on individual coverage for property and medical. However, as they have stated, there is no guarantee that they will do it next time. Given that the initial victim estimates were grossly overstated (at least double of reality), as opposed to 'upping' the amount available to the smaller number of claimants (as potential recipients have suggested you do), I suggest you set aside the 'unneeded' funds for future use in 'making good' on individual insurance claims related to future terrorist actions that may be denied next time around. I can see no governmental justification for any other than token compensation for Twin Tower victims. I think it is admirable for employers to assume whatever obligation they feel toward their employees, but I see minimal obligation on the part of the government. I applaud the thousands of individual contributors to the victim's trust fund and feel the victims are entitled to every penny of this distributed equally to each victim. In my opinion, a dangerous precedent will be set if this legislation remains as is. I say "will be set" because I hope Congress will re-consider this legislation. Among the alternatives would be a cap of some figure, such as $100,000. And worse still, it is insulting to subtract the life insurance that these prescient individuals attempted to use to guard against untimely death. What about other victims of tragedies past and tragedies yet to come? Are we going to do this every time a terrorist act occurs? We haven't in the past, at least not to this extent. Saturday, January 19, 2002 3:59 PM Individual Comment Dear Mr. Kenneth Zwick, NON-ECONOMIC LOSS Arguments are being raised that the non-economic loss compensation being offered is substantially less (some suggest by a factor of 10 to 1) than comparative awards in recent US history. This needs to be addressed urgently particularly as claimants are required to abandon their rights to certain further US action ahead of compensation determinations. There is a large disparity between the compensation in respect of married and unmarried victims. The difference is excessive and I would suggest should be no more than 25%. Further I would suggest that extenuating factors related to the individual circumstances of the deceased should further close the gap. For example where it can be shown that an unmarried partner has been seriously prejudiced and suffers by way of the loss, they should be treated proximate a married partner. There have been hundreds of (largely repetitive) appeals for the fair treatment of same sex partners and far far fewer appeals for heterosexual unmarried partners who need fair consideration particularly bearing in mind our changing social norms. The heroism of the NY firemen and police killed needs to be recognized through this fund category. The suffering of the victims, and their kin now and in the years to come, killed on the upper 15 floors of WTC 1, where there were no survivors, warrants special consideration. For both categories I would suggest an increase in non-economic loss of some 50% over the average granted. ECONOMIC LOSS I suggest the basis for projecting future earnings, namely 1998-2000 taxed earnings together with a growth projection of approximately 5% per year is unrealistic and inequitable to the youth killed ( i.e. under 30 years old) as well as to those advancing at greater than 5% per year in the past few years. Earnings in 2001 should be taken as the starting base. I join the chorus in suggesting that the offset of life insurance sends out a poor signal. I suggest that there can be few sound arguments to justify significant differences between single and married victims in respect of the present value of their projected earnings. This is nothing short of discrimination against the families of single victims. There are also I suggest no grounds for differentiating the present value of substantially the same earnings stream in the cases where there are dependants. If this concept remains can I suggest that as a minimum the category of dependant be at least widened to include parents and siblings depending on the individual circumstances of each deceased. Respondent N001548 suggests that the future earnings discount rate used of 5.13% over the risk less rate is excessive and materially affects the amount of compensation in current terms. This clearly warrants clarification. Wednesday, February 06, 2002 9:01 PM September 11 Victim's Compensation Fund It would be wonderful if all the surviving family members of those who died in the September 11 attacks on our nation were justly compensated. How can our Nation ensure that each and every case is given equal attention and consideration? It seems the fund established by Congress and signed into law by our President is a large step in the right direction, but can it be perfectly equitable? If a person who died at the World Trade Center, or the Pentagon, or the Pennsylvania crash site had life insurance, and that person's family will rightfully receive adequate benefits from that policy, giving the family money from the Victim's Compensation Fund would, in my opinion, be an injustice. Are there people whining about compensation being too little, and sounding greedy? Many of the people who lost husbands or wives or lovers on September 11 need to follow the example of a hero of mine. Her name was . Her husband, a veteran of WWII, died in the crash of his crop-dusting aircraft in 1952, in the days before multi-million dollar wrongful death suits. was left to raise three sons who were 8, 4, and 2 years old. She did not sue the owner of the plane in which her husband died, and there was no life insurance. did receive some Social Security and VA benefits. With the help of her family, completed her college education. She went to work as a school teacher in New Mexico, and made a life for herself and her sons. She eventually earned a Master's degree in art education, and though never financially wealthy, was blessed with many wonderful friends, and eventually retired after teaching many years in the Albuquerque, NM, public schools. She never remarried. A few years before she retired she was diagnosed with MS, a disease that eventually made her a quadraplegic. She was cared for by a nursing home in Albuquerque for the last seven years of her life, which ended January 12, 2002. In short, in some ways, she had rough and tragic life. But... She never complained about the death of her husband, though she grieved his loss. She never complained about the loss of her health, though she did express a desire to be healed. When friends and visitors saw her, her questions were about their lives, needs, and concerns. Basically, when the unfairness of life hit her squarely and brutally, she took a deep breath, and moved on with living. She trusted in God, loved her kids and friends, and did her best. The persons who lost loved ones on September 11, 2002, need to realize how blessed they are! To have a Nation that's trying to help. To have a Congress and Presidential administration that has acted to provide relief, and very generous relief! At least, that's the view from here. And I think I'm entitled to that view. You see, was my mother. I was 2 years old when my Dad died. And I know how much we depended on Social Security and VA benefits. Had someone offered us help from a "victim's compensation fund," it would have been greatly welcomed. I think it's great of our Nation to act with compassion! But regardless of how much money we make available to those living victims of September 11, nothing, nothing, NOTHING, can bring their loved ones back. And the way they can best honor the memories of those who died is to grieve their loss, and then live courageously, and fully, and joyfully!
