Like many others worked as a bond trader at on the 103rd floor. now has three small children ages 3, 5, and 7 to care for and support alone. I am writing to express my serious concerns and objections to the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." I have read the letter that Congressman Marty Meehan sent to you on behalf of the victims. I couldn't voice my concerns and objections any better than he did in his letter. I urge you to strongly consider his objections and recommendations. Specifically I believe it is important to establish a substantial meaningful minimum that all victims will receive. The figure of $250,000 per person for non-economic damages is completely unacceptable and sends a statement to the victims that their losses are not valued in either a legal or humane way. I also want to voice my concern and bewilderment regarding why you have capped the incomes to be used in the calculations at $231,000. I have read and re-read the original bill and I can't find anything in it that required this type of cap on economic losses. I can only assume that this limit was set to appease those who object to the "government supporting these people." Those who have this view need to be reminded that this bill was put in place primarily to protect the airlines and secondarily to address the fact that the victims would have no recourse to sue for just compensation. Please do not give into this pressure of public opinion. All of these families are entitled to be compensated for the full extent of their economic and non-economic losses since they really have no other recourse at this point. I realize that you have a tremendously difficult job to do in balancing everyone's needs and concerns. However, I urge you to do the very best that you can on behalf of all the victims. I have seen first hand how painful their situations are and how much they want to move on with their lives. However, they have a lifetime in front of them in which they must support their families that will need tremendous care and attention for years to come. By fairly and fully compensating them for non-economic and economic losses, they can move on with the rest of their lives. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am writing to express my concerns and objections to the Department of Justice's, (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund;" as there is no place/no where in the documentation/regulation does it even acknowledge the rights of fiancees or domestic partners. Yet, as fiancee myself, I can attest to the fact that we were obviously the most important persons in each other's lives. We had chosen to spend the rest of our lives together, to support one another in sickness and health, many of us planned to conceive and raise children together. We were dependent on one another as confidants, role models, friends, lovers, and in many cases, such as my own, in financial matters. Now, not only have we lost the most important person in our lives - taking away our own lives in many cases - as life now has no meaning, joy or reason - we are told we may not even be considered as recipients in Mr. Feinberg's ruling. It may be that families receive all the rights, yet those who are also family - NEW family (such as fiancees,) those whom could be considered closer than actual family have no rights - this I must disagree with strongly. How can one committee, one man decide whom is worthy and whom is not? and I had been engaged for over a month, but had been dating and virtually living together for three years. We were best friends and spent every moment when we were not working together. provided for me financially, as he was obviously the "bread winner," and although his family may disagree, I was dependent on and he wanted it that way. family has now made it perfectly clear to my family that they do not intend to include me in the financial part of this disaster - in other words I have been "cut off." and I travelled extensively, we rented houses yearly with other couples in places such as Vermont, St. Barth's in the Caribbean, we were to travel to Italy on September 21st, 2001, we ate out alone and with friends regularly, we shopped together - (he often paid for my "everyday needs" at the grocery, drug and clothing store.) paid for all of the above, am I, therefore, not considered dependent or in the exact circumstances as a wife may be? Although we had the ring and were in the process of making plans, we simply had not reached our wedding date of June 2, 2002 before this horrific terrorist attack on the U.S., that has devastated the world, let alone those who lost love ones personally. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
