As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. (ii) Agency actions relevant to the Regulatory Flexibility Act, 5 U.S.C. 603-605, 607, and 609 DOJ has certified that the interim final rule will not have a significant economic impact on a substantial number of small entities. The rule provides compensation for individuals, not entities. (iii) Agency actions relevant to sections 202-205 of the Unfunded Mandates Reform Act of 1995, 2 U.S.C. 1532-1535 The interim final rule does not contain either an intergovernmental or private sector mandate, as defined in title II, of more than $100 million in any one year. We write to urge that in creating the category of those who qualify as "survivors of someone lost in the crashes" under the fund's regulations, we can best carry out the intent and spirit of the law by compensating all of those who suffered both grievous emotional loss from these murders, and significant financial loss as well. In providing such compensation, we believe the federal government should take into account all of those who had a close relationship with the murdered victim and whose own financial position will be adversely affected by the death. Relevant indicia of such a relationship include a shared residence, shared bank accounts for other financial instruments, joint membership in a health plan, a significant sharing of living expenses, etc. Obviously a wide range of different personal relationships will be covered by this, and we believe that this coverage is wholly appropriate in this instance. We note that this is the approach taken by Governor George Pataki of New York, where so many of the victims live. The act we passed was not an effort by the Congress to regulate any set of personal relationships, nor to encourage or discourage people from following nay particular pattern in their living arrangements. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I did manage to get out. However my life has been turn upside down. I no longer have a job. When you go for assistance, I find that you are treated like a heard of cattle. You are sent from one agency to another being informed that the next agency should be able to help you. Most of the time they take all of you personal information and you never hear from them again. Thursday, December 20, 2001 8:39 PM RE: COMMENTS REGARDING SUBTRACTIONS for the Victims Dear Sir or Mam, I for one am totally appalled with the fund for SUBTRACTING any life insurance or pension benefits from anyone who was injured or killed during the Attack. You totally screw any family who planned for their future. I thank God did not lose any friends, acquaintances, or family members in this attack, but I feel totally angered at these subtractions for those families who did. It seems to me it is the governments' cop-out in the failure to protect our citizens from terrorists in the first place. And to further compound the terror, you mess with their future. You want to be fair, or so you say, BUT if that is true then how on earth could you take away and devalue their life or lives the way you are doing? I feel that if the FBI and CIA had been paying attention instead of sitting on their laurels this type of attack wouldn't have been able to take place in the first place. You don't want to be sued or the airlines sued so you cheapskate your way out by such a paltry funding and expect the grieving families to be happy with all these take a ways. I wonder....Is the government so callous, hardened, and uncaring, that if it were each of your family members being screwed by these subtractions, would you be so quick to implement them? You all by rote, spiel out all the words of being upset by these actions, yet you crucify a family for having pensions or life insurance... How is that fair?? Wednesday, November 07, 2001 11:18 PM Comments on victims compensation fund My wife died in the attack on the Pentagon. I have two sons, aged 11 and 7. I strongly disagree that any awards from the victims compensation fund should be reduced by any other compensation received. My wife and I prepared for the future by paying life insurance premiums, contributing to her pension plan, and other steps we took. We made sacrifices so that the one of us who survived, or our sons, if both of us were deceased, would be provided for. It is not equitable that the government should reduce any award my family might receive from the victims compensation fund by the amount of compensation we receive from our prior planning, sacrifice and preparedness. To take this amount away from any award my family would receive would be like stealing from us, like punishing us for having prepared for the future. It would also cheapen and minimize the loss we have experienced, as though accountants were more concerned with the costs than with taking care of people. It would make it as though we had never gone through the effort to budget and to do without to make the premium and contribution payments, or worse, that we done it for nothing. Because we planned ahead, my family is not eligible for most of the financial assistance aid currently available. This is because much of it is need based. I think this is right. I have not even considered trying to apply for funds to cover expenses that I am able to meet with the proceeds from insurance, pension and my regular pay. There are many people in dire straits who need that money. I would not think of taking it from them. So, I am not referring to compensation received from the American Red Cross and other aid agencies. (For the record, I do not think that victims' compensation should be reduced by amounts received from those sources, either.) If an award to my family is to be reduced by the amounts we've received from insurance, retirement, pension, etc., I will probably elect to sue--most likely successfully--American Airlines, Dulles International Airport, the security services involved, and possibly other entities, including governments. If I am forced into this course, I will be required to seek a much larger award than that for which I would be willing to settle if I did not have to go to court. For me, the time and aggravation of going through a suit is a minimal consideration. I do not need the compensation. I can wait years if that is the case. However, I would much rather accept an award from the victims compensation fund--probably much smaller than what I might expect to receive from litigation--if it meant simplifying the process. I think it would be much less costly to, and in the best interest of, the taxpayers, for the government to agree to compensate victims without regard to other compensation received. Keep it simple, be fair, get it done with. Do the right thing once instead of dealing over and over again with doing the wrong thing, or with doing only half of the right thing. The best solution for my family, and I think other victims, is to determine a consistent standard, such as loss of wages, as in our case, and set up a fair formula for pain and suffering. Determine an award in each case, give it to the victims and be done with it. Case law provides ample precedent for doing this quickly and fairly. For me, in consideration of the needs of my family, the bottom line is not the amount of the award, nor is it the time it might take for litigation. It is simply that I do not consider it right that the insurance, retirement, etc. that my wife and I worked for should now be discounted. Do not penalize those who have had the forethought and made the sacrifices necessary to be prepared for loss. I saw a report on FOXNews today that I thought was pretty disturbing. A woman wanted more than the alotted 250,000.00 that she would get for her sons death (whom was 21,had no wife or children and they never depended on his financial support), because that was not enough money to cover pain and suffering. I have a daughter and a husband and God forbid anything happen to them, but I would never be able to put a dollar figure on pain and suffering. I don't care if you gave me all the money in the world, that would not fill the place of my loved one. People lose loved ones to all sorts of different circumstances and most are not refunded of there families lives. And as horrific as this event was, I don't feel as if anyone should get money unless they lost someone that they were financially dependent upon. I think that 250K is more than enough for people like the above mentioned. They are just money hungry! Friday, March 15, 2002 12:16 PM 911 compensation fund It has come to my attention that partners of gay and lesbians victims of the 911 attack on the United States will most likely be unable to recieve compensation for the tragic loses of their loved ones. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
