Friday, December 28, 2001 1:23 AM (no subject) Dear Mr.Zwick, I represent over 200 firefighters who have sustained a wide range of physical injuries on September 11 and in the days and weeks immediately following. It would appear that the definition of "physical harm" promulgated in the regulations would not include many seriously injured individuals who succumbed to pulmonary injuries as a result of working at the World Trade Center. Moreover, the definition, taken together with the phrases "immediate aftermath" and "present at the site" make it difficult if not impossible to determine if a firefighter who was present on September 11 through September 20 would be included or excluded from coverage under the Act if he or she failed to see a doctor within 24 hours of having "sustained" the injury. In most, if not all, of the cases that I am involved in, the pulmonary complications began with in 24 hours of the exposure. However, the firefighters continued to work without proper protection because of representations made by federal and local authorities that the air quality was "safe". I, along with many other trial attorneys, have undertaken to represent these individuals pro bono with the hope that they would be able to make claims under this Act rather than having to commence traditional tort lawsuits. Additionally, since they may suffer from future injuries which could be very severe,it is our belief that they fall within the intent of the original statute. The regulations appear to construe the legislative intent of this Act to be to the contrary. I am certain that it was the intent of both the House of Representatives and the Senate to adequately protect those rescuers who succumbed and will succumb to injury as a result of this event. I would hope that the final rule will redefine both "immediate aftermath" and "physical harm" to include those who attempted to save lives. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, February 06, 2002 9:35 PM Comment on Victim Compensation Fund After reading many of the comments on this site, it is sad to see the idealistic virtues of those who died for others in diminished by those who, like flies to a carcass, seek to feed off of the tradedy of others. I was somewhat concerned that the September 11th fund, while gracious and considerate, went beyond the legitimate mandate of government to provide for the general, rather than individual, welfare. I had no expectation of anything but gratitude for this exceptional effort by government to offer charity to individuals not associated with official government activities. I found it disheartening to see those same individuals biting the very hand that had never offered such financial benefits to other victims of disasters beyond immediate survival assistance and, in some case, low interest loans to help them get back on their feet. I find the whole September 11th fund both bad and improper precident to be taking. The sense of entitlement from the *government* by those who are already the beneficiaries of hundreds of millions of dollars already collected by the private sector for their welfare is a grotesque reaction to the bounty offered, even if improperly, of the people of the United States through their elected representatives. It is not the purpose of government to maintain the "lifestyle," rich or less so, to which people are accustomed. It is a perversion of the principles of democratic government to ignore the truly poor and listen to the ugly whining of those who, through extremely unfortunate circumstances to be sure, want to maintain their large houses or profligate lifestyles (as so many who sadly died in the World Trade Towers were capable of providing, and to whom I begrudge nothing). Millions of people yearly go through the same heartbreaking death or poverty-through-illness (myself included) without so much as a peep that the government somehow required to provide us with our former level of lifestyle. I, in fact, wrote my representative when the issue of disability payments possibly being reduced many years ago by the government asking her to vote in favor (despite the fact that I had paid the government enforced premiums for the insurance that could have been better spent in the private sector insurance market). And my pain and suffering continue in a very real and physical sense, never mind the pain and suffering from being completely isolated from the world of accomplishment I used to know. Evidently the decade of greed declared to have occurred in the 1980's is really only now beginning to accumulate real momentum. Wednesday, March 13, 2002 11:25 PM Kenneth Feinberg's comments To Whom It May Concern: I am saddened by Kenneth Feinberg's comments on "Meet the Press" this past Sunday. I am ashamed that my government would see fit to so openly discriminate against Gays and Lesbians, people who were equally devastated by the events of September 11. I rejoice over the new found freedoms of the women of Afghanistan, but wonder how we can call other governments discriminatory when we won't even acknowledge such a large, politically active, community-oriented group in our own country. Is there something that tells you that gays and lesbians grieve less, sacrifice less, or in any way are less affected than other U.S. Citizens by these events? How can you in good conscience say that you will forgive immigration violations to compensate illegal immigrants, yet ignore and marginalize a group of citizens who were legally employed? How can you look into the faces of the loved ones of those who died - people who loved and cared for the victims as much as any spouse - and tell them that they don't count simply because of their sexual orientation? I think the obvious answer is that you decline to look at them at all. For that you should be ashamed, especially to wrap your discrimination in the cloak of warding off lawsuits, an incredibly specious argument and one not worthy of consideration. Not in this country, not in this time. I hope that you will reconsider your actions, take the right and moral step and compensate those who lost loved ones, regardless of their sexual orientation. The special master has ARTBITARILY chosen to use outdated(1979), national data to calculate potential earnings for individuals who were employed in 2 buildings in New York City. USE UP-TO-DATE, NEW YORK DATA TO CALCULATE EARNINGS. 2. An individuals education and occupation should be considered when calculating potential life-time earnings. 3. THE $230,000 CAP ON YEARLY EARNINGS SHOULD BE REMOVED. My son would have reached these earnings at 25 years of age. Under the current guidlelines his earnings will remain the same for the remaining 37 years until his projected retirement age of 62. 4. The current $250,000 offering for non-economic damages is an insult when you take into consideration the pain and suffering of those individuals in this horrific event. Some jumped from the building, others died of smoke inhalation, others burned, others were trapped in a burning building without a way to escape and died when the building collapsed. TO USE THE AMOUNT OF $250,000 BECAUSE THOSE GUIDELINES ARE USED FOR THE MILITARY IS A JOKE. THESE INDIVIDUALS WERE CIVILIANS WORKING IN MANHATTEN, NOT MILITARY PERSONNEL. With regard to the pain and suffering of the vicitims families, it is continuous. We have had a memorial service on Sept. 28, a burial of very limited remains our 24 year old son, on Dec. 22nd and we were contacted on Jan 22nd regarding additional remains. How does a family escape the continuous pain and suffering we feel? How does our family "come to closure" as we anticipate additional remains? How do I protect my deceased sons younger brothers? We are bombarded with ongoing pictures on tv, the newspapers, magazines, and constant discussion of the event. It is expected that identifications will continue anywhere from 5-10 years. In similar airline litigation, awards range from $2 million - $20 million dollars. If we are unable to litigate, awards should be a minimum of 1 - 2 million, WITHOUT OFFSETS APPLIED. 5. I disagree with the process. All families should be notified in writing what the minimum compensation is BEFORE they waive their right to litigate. 6. Overall, the interim regulations MINIMIZES ALL INDIVIDUALS COMPENSATION. Economists report in the case of all 22 -50 year old individuals in the securities business, their compensation based on potential earnings is devalued 100% , individuals with a bachelors degree or more is devalued by 30%, a firefighter or policeman is devalued by 27%. All I ask is for the special master to be fair and honest. If you're calculating potential earnings, CALCULATE TRUE POTENTIAL EARNINGS. If you are making a reward for pain and suffering, TAKE INTO CONSIDERATION THE TRUE PAIN AND SUFFERING THESE INDIVIDUALS AND THEIR FAMILIES ENDURED. Remember these individuals who lost their lives at work that day were hardworking, taxpaying individuals who contributed significantly to our economy. Saturday, March 16, 2002 5:04 PM Recognize gay partners Dear Sir or Madam, I certainly hope that what I read today was incorrect, that partners of gay and lesbians killed 9/11 will be treated differently that those of married couples. These people were no less in love or in need of their other half, and should be recognized the same way any other half would be in these circumstances. I hope that the help to victims in this tragedy will not be swayed by some people's personal politics or religion (considering that's what created this tragedy in the first place) and America will show that it is a land of people for the people. Saturday, December 22, 2001 1:49 AM Support Crisis Benefits for Gay and Lesbian Partners December 22, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Friday, January 18, 2002 12:21 PM Exaggeration of the award amount I hope that future public comments by Mr. Feinberg will clarify that, under the interim rules, the average payout from the fund under the interim rules will NOT be $1.65 million (which has been repeated over and over in the press and elsewhere). Of course, those who take the time to "read the fine print" know that the average payout under the interim rules will be much less due to deductions for "collateral source" income. But the average member of the public, not directly affected by the tragedy, is unlikely to take that extra time. This disinformation is not helpful to public debate about whether the interim calculations for presumed economic and non-economic losses are reasonable compensation for the loss of the victim. Here is but one example of how that kind of misunderstanding skews public debate about the fund and its rules. I have read many repeated comments apparently submitted to you by the voter.com website that purport to inform you of their latest poll results on the question "Does the government's aid program for families of Sept. 11 victims goes far enough?" I looked at that website and found that voter.com (or whoever else submits those repeat comments) omitted the rest of the question. (You can verify this too, unless they have changed the question in the mean time). Next to the YES button is the further clarification that "The families will get an average of $1.65 million each to help them rebuild their lives." (Wonder where they got that figure?) Moreover, a NO vote (according to the explanation next to the NO button) requires the voter to believe that that a $1.65 million average payout is not merely too low -- but is indeed "ludicrous." Not exactly a fair way to pose the question if you want to sample true and informed public opinion. Hopefully, this attempt to mislead the rulemakers will be properly ignored. Tuesday, March 12, 2002 10:44 AM I was appalled to learn that funds from the September 11th fund will be divied up in such a way that diminutizes important gay and lesbian familial relationships. The inconsistencies of the policy are abhorrent. It is especially predujicial of the funds' allotment when Attorney General Ashcroft is allowing for immigration law to be compromised, but refuses to compensate life partners of gays and lesbians killed in the September 11th attacks. While these individuals gave their lives on that date, it is apparent their loved ones' pain and suffering is less than that of others who too lost loved ones. The judiciousness is an unfair estimate by accepting what was given (someone's life, someone's partner's life) but not giving anything in return. I am disappointed and angered by the unequitable standard that has been set when it comes to all individuals affected by the attacks. It is apparent that the current administration feels some lives are held in higher regard than others. It makes me saddened and ashamed to see our country's government act with such callous and unfair favor when it comes to its citizens that gave so much on that day.
