Monday, March 18, 2002 10:34 PM Final Rule - 9/11 Victim Compensation Fund of 2001 Gentlefolk, In looking at a memorial site for the victims of the WTC, a major inconsistency struck me. People in the government of NY and the government of the United States went out of their way to "naturalize" survivors of undocumented aliens who worked in the World Trade Center and who died in the towers' collapse on 9/11/2001. Decades ago I worked in a restaurant as a prep cook. I'm personally aware of how often undocumented aliens are hired by restauranteurs. Those restauranteurs KNOW they are violating the law and yet they did it 20 years ago and they STILL do it. Unless the undocumented employee has some monetary value to their restaurants beyond that of kitchen prep or cleanup or delivery, these restauranteurs leave the problem of naturalization to their employees as a rule. I have no personal knowledge of how Windows on the World in the WTC operated, but I've seen no evidence to think that they were any different. I find it ridiculous that the compensation fund covers the families of the undocumented aliens who died in WTC, up to and INCLUDING bringing their relatives -- siblings, spouses, offspring, parents; changing from case to case -- AND GRANTING THEM CITIZENSHIP, INCLUDING ANY SIBLINGS, SPOUSES, OFFSPRING NOT US BORN WHO MIGHT HAVE ALREADY BEEN HERE. Yet, gay life partners are ignored. Do you wish to be seen as completely FAIR? It seems to me you have two choices: 1) Apply ALL federal law and regulation EQUALLY -- and rescind the newly conferred citizenship of relatives of aliens killed in the WTC and do NOT compensate them at all. 2) Compensate lifepartners and any adopted children of all lesbian or gay US citizens killed in the WTC. IF you can ignore immigration law, you can ignore the DOMA. My husband is an independent travel agent, not an employee of some huge travel umbrella network. On 9/1/2001, American Airlines cut commission to travel agents to the bare bones. By the end of business that day, all major remaining US carriers followed suit. At that time, that carrier already had cuts in manpower in the works for the next 18 months, and a reduction in flights planned. After 9/11, that airline and others came to you for relief, blaming all of their problems on 9/11, which is unadulterated fabricated poppycock. Since 9/11, over 80,000 travel agents are out of work. Most of them, like my husband were, when they were working, independent contractors and as such they cannot collect unemployment while they search for work. Of course, those first laid off or put out of business are those over 45, who ARE discriminated against when looking for work, ANY work, particularly related work. "Overqualified" is another phrase for "too (CENSORED) old." As of today, three carriers, Delta, American and Continental, have cut their commission to travel agents to ZERO and are "refusing comment" with other carriers to follow. Delta had the "courtesy" to release their news (though after news publication deadline) on Friday, while the other two made their announcements today effective hours prior to their announcements. These airlines have all come to you with their hands out. WHERE IS YOUR HELP FOR THOSE THEY'VE SHAFTED AND THROWN INTO THE STREETS? WHERE IS YOUR COMPENSATION FOR THESE PEOPLE AND THEIR FAMILIES? Hotels are still not running at the occupancy they were prior to 9/11/2001. THEY have all laid off employees. WHERE IS YOUR COMPENSATION FOR THESE PEOPLE AND THEIR FAMILIES? Business who supply hotels and provide services for hotelliers are all hurting, many cutting back on hours and manpower. WHERE IS YOUR COMPENSATION FOR THESE PEOPLE AND THEIR FAMILIES? You're making a few people instant millionnaires. You're making others extraordinarily rich. You're making instant citizens for people you would formerly have rounded up in a raid, thrown on a bus, shipped to Rikers Island and then thrown home on the nearest cheapest transport. You've failed at every turn. I'm EXTREMELY angry, since you've not only let the airlines put my husband and others on the brink of bankruptcy and on the streets with no hope of future employment whatsoever, you've violated your own immigration law and regulations while upholding an unconstitutional law regarding the civil contract of marriage. After the tragedy this nation faced in September, after the months of grieving, healing, and rebuilding, for your organization to deny compensation to the loved ones of gay victims of the September 11th attacks is cruel. It is heartless to tell a group of people that, though they lost loved ones that grizzly day, their loss is not equal to the loss of the other families. That because of who or how they loved, they are somehow lesser Americans. Lesser human beings. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Saturday, March 16, 2002 4:00 PM September 11 Fund To Whom it may Concern, I just read an article regarding the compensation that families of September 11 heroes will be receiving. The article made it clear that it would include illegal aliens family members and fetuses of those heroes, but not those of gay people because state law does not recognize there relationships. In the state of California the state does not recognize the right to live here or gain privileges offered to our citizens if you came here illegally from another country. Nor does it even recognize the right to humanity to a fetus. In cities and counties in California committed gay relationships are recognized, but they are still not recognized by the state. Despite the fact that our state does not recognize the rights of illegal aliens or fetuses those people are being recognized in order to honor those heroes. I do not find a problem with that. I do have a problem with excluding gays based on the fact that there isn't a state that will recognize their relationships. If September 11 should have taught us anything, it should have taught us that we must rely on our strength as a whole country, and not divide ourselves over political differences. I personally am not a gay person, but I am an American just like those gay Americans that died. I find this to be an outrage, and an embarrassment to my country that promotes equality for all people. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked-the World Trade Center, the Financial Capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families." Wednesday, December 19, 2001 10:09 AM Please help December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
