Washington, D.C. 20530 Dear Mr. Attoney General, On September 21, the Congress passed H.R. 2926, the Air Transportation Safety and System Stabilization Act, ("Act"), which was signed into law by President Bush as Public Law 107-42. An important aspect of this law created a Victim Compensation Fund ("Fund"), which was designed to compensate victims of the September 11 terrorism attacks. I hope that the injured and the families of the deceased will utilize the Fund to help recover from these horrific acts, although certainly no financial award can compensate adequately for the damage done to thousands of Americans and their families. Many of us in Congress expressed serious concerns about the Fund which was enacted without being fully considered through the normal legislative process. The Act makes the Federal Government and thus American taxpayer; ultimately responsible for any awards made by the Fund. However, while Congress provided some specifics as to who is entitled to receive an award and the extent of the award, the details are to be decided by the Department of Justice and specifically by the Special Master, a position created by the Act. Thus the Special Master, Kenneth Feinberg, has enormous responsibility to balance the needs of the victims and their families with the knowledge that American taxpayers may end up footing the bill for his decisions. As you and Mr. Feinberg continue drafting regulations and procedures to administer the Fund, I also ask you to consider my thoughts on a specific issue: how charitable gifts to victims and their families should be considered as you determine appropriate awards from the Fund. Section 405(a)(6) of the Act clearly states that the Special Master "shall reduce the amount of compensation determined...by the amount of the collateral source compensation the claimant has received or is entitled to receive as a result" of the terrorist incidents. The term "collateral source" is defined in Section 402(4) as "all collateral sources including life insurance, pension funds, death benefit programs, and payments by Federal, State, or local governments related" to the terrorist incidents. It is was the clear intent of those who negotiated this Act and specifically this "collateral source" provision that the Special Master should give consideration to all significant collateral financial sources when determining awards. As you know, some Members of Congress and other advocacy groups have urged you to issue regulations which would exclude charitable contributions made to victims or their families from the "collateral source" provision. Such an argument flies directly in the face of the statutory language enacted by Congress and Congress's intent. The Fund was established to provide reasonable compensation to victims and their families in lieu of litigation and was certainly not meant to require taxpayers to provide awards in excess of full financial compensation. The American public has responded to the terrorist attacks with an unprecedented sense of charity. According to new accounts, various charities have received approximately $1.4 billion in contributions designated for victims compensation, including the Liberty Fund established by the Red Cross which has raised almost $550 million. In addition, local governments have established funds such as the Twin Towers Fund which has raised $113 million to be distributed solely to the families of public safety officers. Obviously the Department could rationally determine that charitable assistance below a certain de minimis level need not be disclosed as part of the claim process. However, under the Act, large financial grants given directly to victims must be considered a "collateral source" and I encourage you to issue regulations to reflect Congress's clear policy determination on this issue. In summary, you and Special Master Feinberg will be under immense pressure to expand the universe of Fund claimants and to be as generous as possible. I urge you to keep in mind that the Fund was created by Congress as a unique federal response to a situation where normal litigation may have left victims without recovery. The Fund should be administered with both the needs of the victims and taxpayers in mind and with recognition of the impressive charitable reaction of the American people. Handling this Fund properly would be yet another example of your inspirational leadership in these trying times. Wednesday, March 20, 2002 6:43 PM In response to an email I received from a friend: "To protest the exclusion of gay and lesbian partners from receiving U.S.government benefits for their September 11 losses, send a brief e-mail to victimcomp.comments@usdoj.gov" I would personally like to add my opinion to this matter. These people, like any of the other family/marrige partners who lost a loved one in the tragedy, also feel the pain of loss just as deeply as anyone else. To exclude them is to show a prejudice against American citizens in a time of need. It isn't constitutional to exclude any American from the same rights that his or her countrymen benefit from. This importantly should include the partners and children of same sex unions. Thursday, December 27, 2001 7:31 PM Additional Funding This is based on my understanding of what I have read here and read/heard from media. I may be wrong, but I think you will get the idea anyway. There is a provision for funding the compensation fund other than the "taxpayer": (c) ADDITIONAL FUNDING- (1) IN GENERAL- The Attorney General is authorized to accept such amounts as may be contributed by individuals, business concerns, or other entities to carry out this title, under such terms and conditions as the Attorney General may impose. (2) USE OF SEPARATE ACCOUNT- In making payments under this section, amounts contained in any account containing funds provided under paragraph (1) shall be used prior to using appropriated amounts. There is also an estimate of the number of claimants: 5) An estimate of the total number of respondents and the amount of time estimated for an average respondent to respond: 5,000 claimants with an average of 6.0 hours per response. I understand that an estimate for a average payout is $1.6 Million. So I guess if all claimants went this route, you could estimate the total payout at about $8 Billion. I understand that the airlines are being "protected" by placing a limit on suits against them so that it does not exceed their liability coverage. I heard that for United, that was $1.5 Billion per attack. I'm not sure if this is one attack involving 2 planes or 2 separate attacks. But United has either $1.5B or $3B coverage. I will assume that American is in the same boat. Just to be 'nice', lets assume that 9/11 is one attack. So there is $1.5B coverage for United and $1.5B coverage for American, for a total of $3B. This is the 'obligation' of the insurance provider. I have not heard anything about the insurance providers 'being in trouble' or 'not wanting to pay'. So I think the following should be done to provide "Additional Funding" : In a perfect world there is $3B available and 5,000 claimants, that works out to $600,000 per claimant. For each claimant that files for and gets compensation from this fund, the first $600,000 for that claimant should be payable by the insurance carriers ($300,000 from the United insurance provider, $300,000 from the American provider ). The remainder of the $3B of liability coverage would stay with the airline/insurance provider for paying other suits filed (by those who did not accept this fund payment and therefore waived their right to file a separate suit, or by anyone else who wanted to). The cap would still remain - total liability limited to the coverage amount. Frankly, it seems like a win-for-everybody to me. The airlines are still protected. The insurance companies get a lot of 'warm, fuzzy' press coverage (see how patriotic they are). The taxpayer only gets stuck with the overage, not the entire amount. I am sure that between the President, Congress, Department of Justice, blah-blah-blah all parties could be convinced that this is the way to go! Since all kinds of 'special' laws/regulations have been put in effect for this event, I don't see that one more typing up all the loose ends of this type of agreement would be a problem! I would be very interested in learning why this cannot work, if that is the position of "those in charge". I would also like to suggest that you make the "additional funding" figures available to the public on this website. I would be very interested to see what is generated. I haven't heard anything about this topic in the media! I would have thought that the "Bill Gates"/"Ted Turner"/"King-or-Prince Whoever"-types would be stepping forward. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
