It is our view that, absent extraordinary circumstances, awards in excess of $3 million, tax-free, will rarely be appropriate in light of individual needs and resource. At the same time, we want to ensure that victim's families are receiving at least a minimum level of resources to help meet their needs and rebuild their lives. Thus. We have concluded that the families of deceased victims should receive a combined total of at least $500,000 from this program, other state and federal programs, life insurance policies and other sources of compensation. Similarly, the baseline for single decedents should be $300,000. This ensures that every needy claimant's total compensation from this program and other sources will be at least equal to these threshold amounts. For those victims who died as a result of the September 11 aircraft crashes, the presumed noneconomic losses will be $250,000 , plus an additional $50,000 for the spouse and each dependent of the deceased victim. That $250,000 figure is roughly equivalent to the amounts received under existing federal programs by public safety officers who are killed while on duty, or members of our military who are killed in the line of duty while serving our nation. See 38 U.S.C. 1967 (military personnel); 42 U.S.C. 3796 (Public Safety Officers Benefit Program). The latter figures--$50,000 for the spouse and each dependent-include a noneconomic component of "replacement services loss." Since the government is planning to step in and assume legal liability for victim damages due to the September 11th, terrorist attack why not limit award settlement amounts to more reasonable $ 500,000 (families) and $ 300,000 (individuals) amounts to better utilize taxpayer monies. A settlement of this nature appears to be more than comparable to a customary Term life Insurance benefit available to the average U S Citizen. A maximum award for families of $ 500,000 and individuals of $ 300,000 would appear to be more fair and equal and would not consider a victims past employments and future earning potential. Why should any family receive n excessive benefit of $ 3 million at taxpayers expense? An award based upon an individuals future income potential appears excessive and arbitrary and discriminatory in favor of current and temporary high wage individuals. The governments liability should also be funded as much as possible by terrorist frozen bank account funds. maximum awards to Sept 11th victims not only should be reasonable and fair to all victims but also comparable to customary private and public awards and benefits available to the average United States Citizen. The Average U S Citizen would be more than happy to be covered with a Term Life Insurance benefit of $ 500,000 or $ 300,000. Also, the customary Social Security Death Benefit of $ 255 appears much too low in comparison. Again, my main comment is that victim awards should be limited to a maximum of $ 300,000 for individuals and $ 500.000 for families in the name of fiscal responsibility and fairness to all U S Citizens. Government funds are considered limited and available excess funds can be more prudently spent on social and health care programs benefiting needy and uninsured U.S. Citizens. Also, the customary Social Security death benefit of $ 255 for all citizens should be increased to at least $ 1000 to cover burial costs for all Americans. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. Tuesday, January 15, 2002 11:29 AM Relief Fund finds no Relief My husband was killed on 9/11 leaving behind a 4 year old son, a 2 year old daughter and a seven week old daughter whom he never had the chance to meet. I am writing because I am very angry with the way the government has set up the 9/11 relief fund for families. My husband and I had made a conscious decision to purchase life insurance. I do not feel that we should now be penalized for having been forward thinking. If I felt as though I could sue American Airlines (m my husband was on flight 11) I would not be so angry. Friday, November 09, 2001 3:26 PM Fw: Comments on Proposed Rules under the September 11th Victim Compensation Fund Sent: Friday, November 09, 2001 2:57 PM Subject: Comments on Proposed Rules under the September 11th Victim Compensation Fund The following comments are submitted pursuant to the Notice of Inquiry and Advance Notice of Rulemaking with respect to regulations implementing Public Law 107-42 establishing the September 11th Victim Compensation Fund of 20001. INTRODUCTION The basic thrust of my comments are to call attention to the work of the Presidential Commission on Catastrophic Nuclear Accidents, and to its Report to Congress, volumes 1 and 2, dated August, 1990. While this report submitted pursuant to the 1988 amendments of the Price-Anderson Act, (Public Law 100-408) was a comprehensive study of the appropriate means of fully compensating victims of catastrophic nuclear accidents (greater than approximately $7.3 billion) many of the issues addressed in the rulemaking to implement the September 11th Fund were considered in detail in this report from both a legal and public policy aspect. Specifically, with respect to one of the most important issues, the Presidential Commission considered the degree to which payments from collateral sources should be used to offset recovery through a judicial process containing administrative features designed to speed the resolution of cases. The administrative process set forth in the September 11th Fund legislation follows very closely the system set forth in the Presidential Commission report. COLLATERAL SOURCES On pages 93 to 95 of its August, 1990 report the Presidential Commission on Catastrophic Nuclear Accidents recommends that payments from collateral sources should not be used to offset recovery except when a claimant has demanded plenary adjudication (i.e. trial rather than than the proposed administrative claim resolution process). Further, the Presidential Commission recommended that in no case should proceeds from life insurance policies be used to offset recovery. I recognize that the September 11th Fund legislation in Section 405 (b)(6) provides that the Special Master shall reduce the amount of compensation ... by the amount of collateral source compensation the claimant has received or is entitled to receive as a result of the terrorist attacks. While the definition of collateral source means all collateral sources including life insurance, pension funds, death benefit programs and payments by Federal, State or local governments, an open question is whether collateral source compensation includes receipts from charitable donations. In this regard, the consideration of the pros and cons of subtraction of collateral sources in general discussed by the Presidential Commission on pages 93 to 95 of its report, are germane. The Presidential Commission noted that the collateral source rule usually bars a defendant from introducing evidence that a claimant had received compensation from collateral sources such as insurers or governmental benefit programs. The rationale seemed to be that the defendant (called the tortfeasor in the report) should be required to pay the full extent of the damages his conduct had caused, and should not benefit through a reduced award as a result of any compensatory payments received by the plaintiff from third parties. The Presidential Commission noted that "although double recovery arguably produces a windfall for the plaintiff, the rule reflects the value judgement that it is preferable to overcompensate a victim than to inadequately penalize a wrongdoer." The Presidential Commission noted that with tort reform, the collateral source rule has increasingly been subject to debate. At the time of the 1990 report it was noted that 25 states and two federal statutes had restricted or abolished the application of the rule. The Presidential Commission felt that the collateral source rule should have little force under the special scheme of the Price-Anderson Act because compensation, rather than deterrence, is the principal goal of the Act. Further, the retributive function of the collateral source rule is also not relevant in the Price-Anderson context because losses are borne by the entire nulear industry and its ratepayers rather than by the tortfeasor. Nevertheless,reducing awards by the full amount of collateral recovery was viewed by the Presidential Commission as possibly raising substantial considerations of fairness. Where collateral protection has been obtained through the payment of premiums for insurance, for example, reducing awards by the full collateral recovery would result in net economic loss to the claimants. While the Presidential Commission did not consider charitable contributions in its analysis (a non-issue with respect to nuclear accidents) the fairness argument would seem to apply to charitable gifts. The charitable contributions were made by individuals and organizations irrespective of what other compensation, whether through the September 11th Fund system or through lawsuit, the plaintiffs might receive. An after-the-fact use of these funds to reduce taxpayer burden was probably not one that was contemplated by the charity contributers and in at least with respect to this collateral source, the possible "evils" of so-called overcompensation (if such a concept could even exist in the case of these horrendous deaths) must yield to basic fairness for the plaintiffs. OMBUDSMAN While not considered in the Presidential Commission report, the regulations under the September 11th Fund legislation should acknowledge that the use of the fund will entail questions of sensitivity and tact that may be overlooked in the legally-driven compensation scheme with a 120 day deadline for awards. For this reason, I recommend that the rules establish at the ouset an Office of Ombudsman, not as another source of special pleading, but as an assistant to claimants and others through the bureaurocratic maze. PART-TIME AND VOLUNTEER ASSISTANCE These are new and untried approaches both for the plaintiffs and judicial and executive governmental bodies involved. Wednesday, January 16, 2002 4:05 PM Fund inadequacies It is my understanding that the Victim?s Compensation Fund was designed to provide victims? families with an alternative to suing the airlines, thus acting as an ?out of court? settlement. Using this as a basis, there are a number of questionable attributes of the fund. When someone settles out of court, I do not believe that his/her age, marital status or income is a factor in determining the amount to be awarded. If two people were killed in a car accident, one should not receive more money than the next simply because he/she made more money than the other. Also, a victim?s insurance policy and pension plan would never be figured into a court settlement equation. I strongly feel that every victim should be treated as equal. All of the factors that are being juggled around in order to try to come up with a ?fair? amount for each family are completely subjective and open to much debate. Under the guidelines as I understand them, the most monetarily beneficial characteristics a victim could possess include youth, money, dependent children and little or no pension/insurance funds. At first glance, it may seem logical and even ?fair? to use these criteria. However, after further reflection, one could make a case for why each of these factors should not necessarily dictate payment of more money. For example, one could argue that just because someone was younger and had many years to work, doesn?t mean should be awarded more money. Some hypothetical reasons might include that his/her spouse is also likely to be young and more able to earn a living in the future, and even, perhaps more likely to re-marry at some point. Furthermore, no matter how many family members someone may have left behind, that does not make it any easier for those who mourn. In fact, some may contend that having children, although a financial responsibility, may actually serve to ease the burden and suffering, which may otherwise had to have been tackled alone. While it is impossible to begin to grasp the incredible number of diverse situations families are in, I will share my own story as an example. I lost my father, , who worked for the of for 35 years. He and my mother had been together since the age of 12 and had been married for 35 years. 25 years old, I am the middle child of three, with my younger brother at 20 and my older brother at 26. My father, who had just turned 55 years of age had planned on retiring within months. Unfortunately, by the funds? standards, my father has more than a couple factors working against qualifying us for funds. To start, he didn?t make a lot of money, relatively speaking (around $60,000). Because of his age, he would not have worked many more years. Since he did work for for 35 years, he had a reasonably generous pension, which he had worked so hard for his whole life. According to our calculations, our family?s total payment under the rules as they stand would give us a $100,000 payment. When figures ranging in the millions are being discussed, a number so significantly lower comes as a harsh reality. I doubt anyone would disagree that this is not nearly enough to live on for any significant period of time, nor is it a reasonable or ?fair? compensation for my father?s life. With the fund set up as is, we are not given a choice. With today?s life expectancies and our culture?s lifestyle, it is accurate to say that a major part of his life was just beginning. Now, in my mother?s eyes, her life has ended as well. The fund?s foundation and guidelines are simply insulting and hurtful in so many ways and to so many people. One should never have to look up on a chart to figure out how much their loved one is ?worth,? especially when their value is listed side by side for comparison with the ?worth? of others who were lost in the same tragic, devastating manner. A set amount should be divided equally among the victims. This is not about who needs more to live on or who would have made more money in their lifetime. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
