Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Zwick, Director Office of Management Programs Civil Division U.S. Department of Justice Main Building, Room 3140 950 Pennsylvania Avenue Washington, DC 20530 RE: Presumed Economic and Non-Economic Loss Tables Dear Mr. Zwick: I am writing to make two comments regarding the Presumed Economic and Non-Economic Loss Tables and the Interim Final Rules. 1. Discount Rate In calculating economic damages, a victim?s future earnings are reduced by the income taxes that would have been payable on such earnings. When the after-tax earnings are converted into a present value figure, the interest rate used is 5.13 percent. The Presumed Economic and Non-Economic Loss Tables explain that this rate is ?equivalent, given the other components of the calculation, to a long-term, risk free interest rate.? See Step Four of the Calculation of Economic Loss. There are three problems with this rate. First, the rate of 5.13 percent is clearly not available on safe tax-free instruments; it is a taxable rate. Thus, the present value of the damages is calculated using a victim?s after-tax earnings and a fully taxable discount interest rate. Because the replacement income stream generated by a taxable instrument will be subject to income tax to the extent of interest included, the victim?s family will not receive after-tax income equivalent to the after tax earnings of the victim. Second, the calculation of the victim?s future earnings presumes that the victim would continue to work ?for a number of years equal to the average expected work life as defined by the U.S. Department of Labor, Bureau of Labor Statistics, ?Worklife Estimates.?? See Step Three of the Calculation of Economic Loss. But the expected work life may be considerably shorter than the ?long term? presumed when setting the discount rate. The expected work life of a 65-year old man would probably be much shorter than the 30-year maturity of a long-term bond. Third, a typical long-term bond pays out only interest until the bond?s maturity, at which time the principal amount is returned On the other hand, the victim?s earnings would have been received in a series of substantially equal payments. Thus, the effective term of the victim?s earnings is shorter than the effective term of a bond that matures at the end of the victim?s expected work life. The discount rate should be adjusted to the rate available on short-term, tax-free investments, especially for those victims whose work life expectation is relatively short. 2. Non-Economic Damages Non-economic damages are presumed to be equal to $250,000 plus $50,000 for each of the victim?s spouse and dependents. Thus, the family of a financially dependent child merits the additional $50,000; the family of a child who was not financially dependent on the victim does not merit the additional amount. This is an astounding distinction when calculating non-economic damages. The dependent child deserves every consideration, certainly in excess of the parsimonious figures in the Presumed Economic and Non-Economic Tables. But more to the point here, why economic dependency is a factor in setting non-economic damages? It should not be. I am not an orphaned child, but I was orphaned on September 11. I loved my father no less after I stopped needing his financial support, and he loved me the same way. The Tables? clear suggestion to the contrary is odious. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." My name is and i would like to voice my objection at the way you have handled the distribution of funds to gay and lesbian partners of those who died in the tragedy of September 11. through various news reports i have come to learn that on Sunday's "meet the press", Kenneth Feinberg announced that the money that will be given to the partners of those who had loved ones pass on September 11 will only be distributed according to state law, without federal interference in the same press conference he also announced that the fund would be open to those who are not American citizens and that the federal law would be overlooked in an effort to be more compassionate to those who lost families in the tardy but for whatever reason are not us citizens. These two conflicting points are not my only concern but only the beginning my main issue is that the federal government has chosen to overlook the many gay and lesbian citizens in the united states and in the process also make a very strong statement indicating that even non-us citizens are more welcomed in this nation than they are. it is a sad day when discrimination is so blatant and accepted that even in a tragedy an entire group of people can be treated like second-class citizens or better not a citizen at all. i am deeply disturbed by this lack of compassion and the inequality that has happened in the wake of what should been a unified time. i am for very good reason, ashamed to be an American in the presence of such discrimination, and i hope that this point is reconsidered and changed. if not, all that we love and cherish about the idea of freedom and equality is lost at the time in which we need it the most. gay and lesbian partners might not equate to the same thing as wives and husbands in the eyes of the law (at least not yet) but their loss and pain is equal, and should be treated as such. to do anything less would be a disgrace to all who died on that day (many of whom were gay) and a disgrace to all we hold dear, especially the idea of "equality". i sincerely hope you rethink this position and do the only thing worth doing, the right thing. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. They raised to have morals and values and they taught him to do what he believed in. On September 11, 2001 - put these teachings into effect. This is un-American. How much more is this country going to discriminate? I am certain you can find a way to determine through questionnaires how to find out who had lesbian and gay partners. You do realize it's not easy to be 'out' in America? Those that are willing to answer yes to a questionnaire about having a partner are probably being truthful. Yes, there will be those that take advantage of the system, but to completely ignore a whole sector of the community for this purpose is preposterous! Please give this issue some thought!
