Monday, December 03, 2001 8:36 AM administration of funds for compensation of families of tragedy I hope that the funds will be equally distributed among ALL the families of the victims of Sept. 11th. Discrimination would be another tragedy. Gay life partners and unmarried heterosexual partners have had the same emotional and financial devastation as the "traditional families". As a stay at home lesbian mom I know the loss of my partner in such a sudden and sensless way would be emotionally devastating, but the loss of income and benifits would make it more than I could cope with. It would compound the tremendous impact on the children. They would then have to deal with the added burden of no income, and immediate life style changes as I would have had to get a job and leave them a soon as possible, on top of the loss of a parent . Regardless of someones religious or moral beliefs, this country is based of equality for all. That is what separation of church and state is all about. Please remember these unfortunate victims when deciding on the rules for the fund. A victim is a victim. And there has been more than enough sensless tragedy in this country. Tuesday, March 26, 2002 2:51 AM Disrimination of 9/11 I just finished reading an article about the September 11 relief funds that made me ashamed to be in this country. It sickens me that a person of illegal status in the country can receive funds, but someone born and raised, who works each day, pays their taxes, and is a credit to the country, cannot receive this fund, only because of the sexual preference they have. I do believe that it is illegal in this country to discriminate against people because of ones sexuality. I know it's against the law to discriminate against people because of their religion, if they have HIV/AIDS, if they're female, or if they have a different skin color, and no one slides on those rules, they're set in stone. So why is this law able to bend? Why can people look the other way a gay man or a lesbian women is concerned? Did they not suffer the same? Was the pain not as real because they came home and cried with a person of the same sex instead of the opposite? Were their tears not as frequent? Their heartache not as real? Is a person of less value because of a choice in their life? And may I add that it is not a choice to be gay, it is a choice to be open about being gay. So would you rather have people hide their true selves from the world? To be fake and pretend to be happy with the wife they don't love and the kids born into a fake relationship? I think that would constitute much more of a problem then a few people looking the other way when a male couple walks down the street. This entire ordeal has made me sick, and more ashamed of my American blood then I ever thought possible to be. Isn't this the land of freedom? The land when people are free to be themselves, no matter what anyone else thinks of them. The land of opportunity. Shouldn't everyone have the opportunity to grieve? To receive the same treatment as every other person during a time of great sadness? If this is what the government calls Freedom and Opportunity then someone needs to hand them a dictionary. Or better yet, put them in the shoes of a gay man, a person infected with HIV/AIDS, an Atheist, A women, and see how well they hold up, see how many things are changed. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. These victims, be it New York, Oklahoma or where-ever, did only what we do every day - they went to work. Domestic partners and the children of gay parents should be allowed to receive benefits; their loved ones' sexual orientation and marriage licenses should not be the defining measure of who is eligible to receive benefits. Please do the right thing. It was a gay man who was instrumental in saving American lives by fighting the hijackers on one of the American airlines' flights (the one that crashed in Pennsylvania). Surely anyone who believes in justice and fairness and equality for all will recognize that the domestic partners and children of gay people are just as deserving, and just as grief-stricken, as those in traditional heterosexual families.
