They all vote. They all pay taxes. They are all American citizens, and they all consider themselves to be proud Americans--even though America cannot decide to be proud of them--even when some of them are heroes. I realize that gay rights is too big a subject for an e-mail conversation, so I will simply say that I am profoundly disappointed in your decision to back away from sharing the compensation for victims of the 9/11 attack on America with the survivors of gay and lesbian partners. You fear lawsuits from those states that refuse to recognize their partnering as meriting government protection and recognition. There was a time, Mr. Feinberg, when black Americans would also not have been recognized as meriting the protection of the government of the United States, much less recognizing them as citizens entitled to the full protection of the Constitution. We have all lived with a burden of shame because of the fearfulness of men in government early in our history--men who knew slavery was wrong, yet did not have the courage to stand up against it. In issues of education and health care, California has done its worst to deny illegal aliens benefits or protection. Now you have the opportunity to be a courageous man in history, one who can stand up and say that the government of the United States belongs to all it's citizens, regardless of the attitude their state of residence adopts. You have promised benefits to those who are in the country illegally, who pay no taxes, who are not Americans, but who suffered as a result of the attack on America. You simply cannot let political agendas sway you away from the truth that the gay and lesbian persons who suffered ARE Americans, those on the planes and on the ground at Ground Zero, and those left behind to mourn. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. I am a 69 year-old father who lost a 30 year-old son at the World Trade Center. A son that would have provided me with much love, happiness and comfort in my twilight years. There is no amount of money in the world that could ever compensate me for that loss of affection. The Interim Final Rules are a step in the right direction. They try to take a very complex legal problem and simplify it. I commend the Special Master for trying to eliminate the need for victims' families to go through a long complicated and expensive legal process. Unfortunately, in trying to reach this idealistic goal, the Interim Final Rules totally ignore the law that was enacted by the Congress and signed into law by the President. Congress did not intend that the non-economic loss of the victims of the terrorists attacks be equated to "roughly equivalent to the amounts received under existing federal programs by public safety officers who are killed while on duty or members of our military who are killed in the line of duty." If Congress intended to do this they would have put it into law. In layman terms what Congress did say was . . . We have to bail out the airlines in order to salvage our economy by enacting the The Airline Stabilization Act. We will also ensure that the airlines remain solvent by protecting them from any litigation resulting from their failure to provide a safe transportation system by enacting the "Victim's Compensation Fund". In the eyes of Congress the "Victim's Compensation Fund" was intended to fairly compensate the victims and their families for their tragic losses and eliminate lawsuits against the airlines and the government. However something happened between the Law and the Rules. Congress said that the victims' families should be compensated for 12 different categories of non-economic loss such as pain and suffering etc., etc. The Special Master said no . . . "give them the same $250,000 that anyone in the military service would get for loss of life". But isn't this comparing "apples and oranges"? A military person would be awarded $250,000 for loss of life whether that loss of life is in combat, by natural death or by accident. That same military person or that person's family could also- - - - - Purchase additional life insurance for amounts in excess of $250,000 without any of the excess amounts being deducted from what his or her survivors would receive. Not so with the victims of September 11, 2001. All insurance proceeds by law are deducted. - - - - Collect the $250,000 in insurance and then also bring a lawsuit against an airline or a third party for wrongful death. Not so for the victims of September 11, 2001. If they accept the award of the Special Master, they are prohibited by law to litigate. The final result of the Interim Rule is not fair and just to those who have lost a loved one on September 11, 2001. The intentions of Congress in enacting the law and the intentions of the President of the United States in signing the law clearly indicate that the victims should be treated on the same basis as one who brought suit against the airlines or government. The non-economic loss suffered by the victims of this horrific event should be less than the amounts that would be obtained by victims that have to litigate through a long and expensive process. That is the tradeoff for a speedy decision and no expensive litigation fees. However that tradeoff shouldn't result in extraordinarily low awards to victims' families. Much has been made in the media about the average award being $1.65 million dollars. This number is truly misleading and doesn't take into consideration the collateral offsets required by the statute. Since many insurance awards are doubled because the tragedy resulted in accidental deaths while the victims were at work, these insurance awards are substantial. The average payoff will probably be considerably less than half of the $1.65 million that was released to the media. The net result is also substantially less than jury awards in airline wrongful death cases. In New Mexico in 1994, a jury awarded $2.9 million in damages to a woman who was burned when she spilled a cup of coffee she had purchased at a drive-through window at a McDonald's Restaurant. I am sure that the woman involved suffered much pain from the hot coffee. I am also sure that the pain has long since gone away. The pain of losing a loved one on September 11th is much more substantial than a spill from hot coffee. The pain of the families of the victims from the tragedy of September 11 will last through their entire lifetimes. The $250,000 in non-economic losses proposed by the Special Master contradicts the law and the intention of Congress. The non-economic loss should be established at a level of at least $1,000,000. This would be considerably less than an amount awarded in a wrongful death lawsuit for non-economic losses in an airline disaster. It would also go a long way toward bringing equality between the awards to low-income victims and those victims that enjoyed higher salaries. Thank you for considering the above comments. We are very concerned that while formulating the regulations for the Victims Compensation Fund, you take into account the following: OPPORTUNITY TO BE HEARD First and foremost, we are concerned that and her children will not be given a complete and full opportunity to be heard, should they choose to do so. Each survivor rightfully deserves the opportunity to be fairly heard before a hearing officer. The survivors should have the occasion to present evidence through their own testimony and the testimony of expert witnesses. Each of their cases should be considered on a case-by-case basis. For , being given the right to be heard is a crucial and extremely valuable part of her healing process. We hope you understand this. RIGHT TO APPEAL AND FORM OF PAYMENT Secondly, we would like the survivors to have the right to appeal, but in addition, we believe the payment should be in one lump sum, and be paid out to the beneficiary, consistent with what investment advisors recommend as the best for their individual family circumstances. For example, the survivors should be allowed to request that any payment made to minor children should be in trust. The parent should determine the date of vesting. The trust should not automatically vest at the age of 18, unless the parent determines it is in the best interest of the child to do so. ECONOMIC LOSSES Third, and of paramount importance to the survivors, is the computation of economic losses. We are strongly against any cap being placed on this portion of recovery. Simply put, no one should be penalized because his or her spouse worked long, hard hours and earned a "good salary". We would request an approach like that used in personal injury actions. Retirement should be set at age 68. The decedent's income should be averaged over the past 3 working years. The decedent's age should be subtracted from 68. Those two numbers should be multiplied together, thereby gleaning a starting point for computation. From this base point, other factors such as inflation, wage-increases, merit, likely bonuses and advancement and any other benefits should be considered. NON-ECONOMIC LOSSES evaluated individually. Each case should take into account the age of the decedent, marital status of the decedent, and the amount and age of the decedent's children, the severity of the pain and suffering of each affected individual (both mental and physical), including the person injured or killed, the spouse, the children and the parents. Compensation for non-economic losses is crucial for the survival of some families like the firemen and policemen's. Those families will need a substantial amount of money to be offered in this section to entice them to enter the fund. Likewise, any family who has a considerable amount of coverage in life insurance will need some incentive to enter the fund, since life insurance proceeds will be deducted from any recovery. We certainly hope that any non-economic recovery from this fund would be generous in light of the terrible circumstances of September 11th. COLLATERAL SOURCES Finally, with regard to collateral sources, we are very concerned about their use to offset any amount recovered from the fund. Life insurance should not be deducted from fund payments. Life insurance is not taxed by the IRS for one reason - it encourages people to plan for their heirs. To deduct any life insurance from fund payments would penalize those who were merely responsible estate planners. The decedents sacrificed and saved hard-earned money to pay for such plans; they are already victims once. Please don't make them victims twice. Moreover, pension fund, IRS's and 401k plans should not be deducted from the fund's recovery amount. These plans were responsibly sacrificed for and saved for by 's husband. They are essentially savings accounts, and they should not be deducted from any recovery from the fund. With regard to charity, Americans across this country donated their hard-earned money as a symbol of their patriotism, and our brotherhood as a nation. To deduct this charity money from any final payment would be wrong. Donations made to, 's family and others like hers were generously and selflessly given to them as a form of healing for both the donor and the receiver. Every single dollar donated and received gives each of us hope for tomorrow and belief in our counry as a united whole. Please do not denigrate this beautiful symbol of our nation standing together as one. Other than our parents we have no family. My brother and I planned to always take care of each other. He did leave me his estate in the hope of taking care of me and my children for the rest of our lives. His estate will do that IF we are NOT taxed at the 55% tax rate. We are finding that the parents and siblings are being forgotten in this whole process of compensation. Because I am not a wife I am being treated differently. Our loss is just as great as someone who lost her husband. I believe under these circumstances we should not have to pay any tax on estates that are left to the beneficiaries of victim's of 9/11/01. My brother was 32 years old and had his whole life in front of him. He was just getting to the position where he was achieving the financial rewards of all his hard work. Wednesday, January 09, 2002 2:43 PM Comments on Interim Final Rule My name is &nbsp&nbsp&nbsp&nbsp and I lost my husband &nbsp&nbsp&nbsp&nbsp in the World Trade Center on September 11. I have reviewed the interim final rule and I have several comments. I should say initially that we were an average family of modest means without expensive spending habits, both of us worked in order to meet monthy expenses and to try to put aside for our daughters' college tuitions and for our retirement. I echo the many comments from families and commentators who have stated that the compensation amounts (economic and non-economic) are too low. This would be true even without the deductions for collateral source income, but they are insulting for most moderate income families with the deductions considered. I read with interest that the award levels were picked based upon various comparisons in our society (including awards from lower cost areas of the country), but in none of those comparisions was there a deduction feature (collateral source income) which is a component of our situation as the result of the legislation. So the award comparisons are really meaningless except for those without any pension or insurance and those who do not collect social security or workers compensation for example. I read that you are hamstrung by the legislation congress gave you, but the compensation levels set are what puts the nail in the coffin. I'm attaching for your interest a spreadsheet showing how my family is treated under the regulations. WE WILL GET NOTHING, despite my sincere belief that Congress intended that the government should compensate victims of this international terrorism against the United States which resulted in my husband's death. I saw you on the NewsHour and read your press conference statements and you make a convincing case that bringing a private lawsuit in this situation will be unlikely to result in any award. What you didn't mention specifically is that part of the reason for this is that in rewriting the liability laws of the country for this event, Congress apparently, intentionally or unintenionally, made suits by persons such as me virtually impossible by limiting the airlines liability to $1.5B. I again believe that when Congress did that, it was working under the assumption that most victims' families would avail themselves of the fund -- it's unfortunate that in its haste to pass this law no one apparently had time to run the numbers for a typical family. I appreciate your attention to these comments and hope that you are able to revise the rules and will work with Congress to amend the legislation so that the Fund becomes viable for me and others like me and not just a source of frustration and heartbreak.
