Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a diswasher in one of the restaraunts destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I find the amount being compensated to victims to be appalling. To compensate an average of $1.6M per victim (tax-free) boggles my mind. Given the sacrifices that have been made by American over the past 225 years, to decide to compensate the families of these victims is not consistent. What about soldiers who have died in wars, victims in Oklahoma City, those who have been victims of racial injustice, etc..? I agree that there needs to be some compensation for those in need, but that should occur only in cases of need and ONLY when dependents are involved. Are non-dependents eligible for compensation, including parents, siblings, etc? What claim should they have to compensation other than memorial expenses? This is a bad program. Given the federal expenditures spent in avenging the deaths, the costs incurred in rebuilding and the other sources of victim help which have occurred thru charitable causes, this is an additional cost that is unnecessary. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the partners and the non-biological children of gay, lesbian, bisexual and transgender (LGBT) victims. Friday, March 22, 2002 6:24 PM domestic partner compensation To Whom It May Concern: It seems that since the "pain and suffering of victims or loved ones" is a component in determining the distribution of compensation for non-economic losses, then domestic partners fall under this aegis, especially in cases of same-sex domestic partners. Same-sex partners may be spouses in every way possible, but, unlike opposite sex partners, are forbidden to formalize legally their relationship. This restriction, which is out of their hands, should not be used against them to deny their right to compensation for their loss. Let's not forget the heroic role played by people such as the gay man aboard the plane that crashed in Pennsylvannia, who helped overpower the hijackers, thereby averting even more deaths. Wednesday, November 21, 2001 11:07 AM Victim's Compensation Fund To Whom It May Concern: I lost my cousin, who was working in the World Trade Center on September 11th. He is survived by his wife, and two daughters. I have a very strong interest in seeing that they, and the other victims' families, are fairly treated. The proposal to consider "any collateral sources of compensation" would unfairly penalize and her family because my cousin had the foresight to pay for life insurance over the past 18 years. Why should this have any bearing on compensation? A court would not consider it, were to sue the airlines for their security lapses, which led to the disaster. In fact, this federal compensation is meant to protect the airlines and the families from years of legal wrangling. would give up her right to sue in order to receive her share. In this context, it is patently unfair to gauge victims' compensation to other insurance claims or charitable contributions they receive. They were no less wronged than the poorest or most unprepared families. It is equally unacceptable that would be unable to appeal the Special Master's decision on what she and her family will receive. She is giving up all her legal rights, and putting herself at the mercy of the Department of Justice. I will live with this horror for the rest of my life. My brother was married and had no children. This loss has completely shattered my life. In spite of the fact that I have now become an only child and that I will have to look after my elderly parents on my own, and that I lost a year of my postgraduate studies, that I had to have masses of therapy, and have been barely functioning in my job, I don?t seem to be eligible for any compensation according to the Final Interim Rule. The fund only recognises the spouse and children as family members. The fund does not consider my own or my parents heartache, and I am outraged by that!. What family values are reflected in the rule? How ould parents and siblings not be considered to be affected by this terrible tragedy? Did my brother stop being my brother the moment he got married? Not only spouses, but also all parents, children and siblings of victims (whether survived by a spouse) have been affected by the trauma of the September 11th disaster and must be presumed to be eligible for compensation under the Act. A Parents' and Siblings? Pain and Suffering should be part of the fund's regulation also. More than monetarily, it will acknowledge that we do exist and that we are suffering too. Additionally, the regulation should clearly state that surviving family members have their own , derivative claims. The regulations should also create uniform rules addressing which family members are entitled to share in an award and how they will share in the award. Special Master FROM: RE: Comments on the Regulations governing the September 11th Victims' Compensation Fund I am an associate with the New York office of . As part of the legal mobilization organized by the Association of the Bar of the City of New York ("ABCNY"), I have been acting as a Facilitator to an unmarried domestic partner of an individual killed in the World Trade Center disaster. I attended the meeting at ABCNY on January 17th, 2002, at which you and the Deputy Special Master spoke. Among the issues addressed during the question and answer part of the evening was the entitlement of unmarried domestic partners to compensation through the Victims' Compensation Fund (the "Fund"). I was relieved to learn that unmarried domestic partners will, in certain cases, be entitled to compensation (although the application must be made by the deceased's Personal Representative who, in cases of intestacy, will generally be a family member and not the unmarried domestic partner). My understanding from the January 17th meeting is that unmarried domestic partners who received substantial financial support (as distinguished from mere intermingling of finances) are eligible for compensation. However, this position is not readily apparent from the regulations governing the Fund issued by the Department of Justice (the "Regulations"). Section 104.43 of the Regulations provides, in relevant part: "In reaching presumed determinations for economic loss for Personal Representatives bringing claims on behalf of decedents, the Special Master shall consider sums corresponding to ... the number of dependents who survive the decedent; whether the decedent is survived by a spouse; and the amount and nature of the decedent's income for recent years". Similarly, Section 104.44 provides, in relevant part: "The presumed noneconomic losses for decedents shall be $250,000 plus an additional $50,000 for the spouse and each dependent of the deceased victim". To protect the rights of the unmarried domestic partner who received substantial economic support from a decedent, the Regulations should be amended to include, after the word "spouse" in each of Sections 104.43 and 104.44, the words "or unmarried domestic partner who relied upon the decedent for in excess of fifty percent of his or her support". The "in excess of fifty percent" benchmark is that used by the New York State Crime Victims Board in assessing an unmarried domestic partner's entitlement to an award for loss of support and would therefore seem an appropriate benchmark for use by the Fund. In the alternative, the Regulations should render clear that a "dependent" for purposes of Sections 104.43 and 104.44 is deemed to include an unmarried domestic partner who received in excess of fifty percent of his or her support from the decedent. I am extremely concerned by the absence in the Regulations of triggers to ensure that an unmarried domestic partner who received substantial support from the decedent receives the portion of the award to which he or she is entitled. At the January 17th meeting, I addressed this concern with the Deputy Special Master. I indicated to the Deputy Special Master that, in cases where the relationship between the decedent's family and the unmarried domestic partner is acrimonious, the Personal Representative may very well refuse to include the unmarried domestic partner in the application to the Fund. In response, the Deputy Special Master stated that the unmarried domestic partner may, under separate cover, submit evidence of his or her loss of support as a supplement to the Personal Representative's application. However, the Regulations do not include a procedure for submitting such supplemental information (for example, it would not appear that a special application form will be made available by the Fund for this purpose). Further, assuming that the Special Master recognizes the unmarried domestic partner's entitlement to compensation and increases the size of the award proportionately, it does not appear that there are any triggers in the Regulations obligating the Personal Representative to distribute the appropriate sum (or, indeed, any sum at all) to the unmarried domestic partner. Section 104.52 of the Regulations ("Distribution of award to decedent's beneficiaries") states, in relevant part, as follows: The Personal Representative shall, before payment is authorized, provide to the Special Master a plan for distribution of any award received from the Fund. Notwithstanding any other provision of these regulations of any other provision of state law, in the event that the Special Master concludes that the Personal Representative's plan for distribution does not appropriately compensate the victim's spouse, children, or other relatives, the Special Master may direct the Personal Representative to distribute all or part of the award to be distributed to such spouse, children or other relatives. When I raised the absence in the Regulations of any mechanism protecting the unmarried domestic partner's rights to a distribution of a portion of the award with the Deputy Special Master, his response was that, if the unmarried domestic partner did not receive the appropriate distribution, he or she would then be entitled to sue the Personal Representative in state court. In my view, this is an unacceptable burden to place upon the unmarried domestic partner, as he or she should not be placed in the position of having to litigate to assert his or her rights when the Special Master has already acknowledged his or her entitlement to a portion of the award. The unmarried domestic partner's rights could easily be protected by amending the provisions of Section 104.52 to include a reference to anyone recognized by the Fund as a dependent of the decedent (including an umarried domestic partner who received in excess of fifty percent of his or her support from the decedent) when the size of the award was being determined. I can understand making some deductions from the economic portion such as SS and any payments made that the victim did not contribute to in additional Life Insurance the company provided and Company matching 401K's but how can you deduct something the Victim paid for themselves. AND HOW IN THE WORLD CAN YOU THEN CROSS THE LINE AND MAKE THESE DEDUCTIONS FROM THE NON-ECONOMIC AWARDS. THE NON-ECONOMIC AWARD SHOULD NOT BE TOUCHED IN ANY WAY. My Sister lost her husband. All we want is to be treated fairly. But we will sign nothing until the numbers are on the table. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
